Seeking: Use variance for a two-family dwelling in existing structure
Our client came to us seeking to use her CMX-2 property as a duplex in the East Point Breeze neighborhood. She wanted to be able to rent the first floor space as a residence because she was having a significantly tough time renting out the commercial space to a business.
In CMX-2 districts, the building must utilize a portion of the space on the ground floor for a commercial use. Sometimes, this is easier said than done in certain areas.
The commercial space was a podiatrists office for many years, but once that office closed, the space sat vacant for a great deal of time. Our client proved to us and thus we were able to prove to the board a significant hardship: She actively marketed the property for over a year, and in that entire duration only had one interested party come in to look at the space.
This was enough to sway the neighborhood association as well as the zoning board to grant the use of the space for a two family dwelling.
